Terms of Service

1. Definitions

"Nextmotion" refers to Nextmotion SAS, a company registered in France, providing cloud-based software solutions for aesthetic and medical clinics.

"Service" refers to the Nextmotion platform, including all web and mobile applications, APIs, and related services.

"User" refers to any individual or entity that accesses or uses the Service.

"Subscription" refers to the paid plan selected by the User to access the Service.

2. Acceptance of Terms

By accessing or using the Nextmotion Service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.

Nextmotion reserves the right to update these terms at any time. Users will be notified of material changes via email or in-application notice. Continued use after notification constitutes acceptance of the revised terms.

3. Description of Services

Nextmotion provides an all-in-one cloud platform for aesthetic clinics, including but not limited to:

  • Patient records and consultation management (Consult)
  • Before/after photo capture and documentation (Capture)
  • Online appointment booking (Agenda)
  • AI-assisted transcription and copilot (AI Copilot)
  • 3D aesthetic simulation
  • Patient-facing digital journey (Nextmotion Beauty)
  • API integrations for third-party systems

4. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify Nextmotion immediately of any unauthorized use of your account or any other breach of security.

5. Subscription and Payment

Access to the Service requires a paid Subscription. Pricing is as described on our pricing page and may be updated from time to time with prior notice.

  • Subscriptions are billed monthly or annually depending on the plan selected.
  • Payments are non-refundable except as required by applicable law.
  • Failure to pay may result in suspension or termination of access to the Service.
  • Cloud storage fees are billed separately based on usage tier.

6. Data Ownership and Responsibility

You retain all ownership rights to your data uploaded to the Service. Nextmotion acts as a data processor on your behalf and will not access, use, or share your data except as necessary to provide and improve the Service, or as required by law.

You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including healthcare and data protection regulations.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Upload malicious code, viruses, or any content that may harm the Service.
  • Share your account credentials with unauthorized third parties.

8. Intellectual Property

The Service, including its design, features, algorithms, and documentation, is the exclusive property of Nextmotion and is protected by intellectual property laws. Your Subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

9. Service Availability

Nextmotion aims to provide 99.9% uptime but does not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. Nextmotion is not liable for downtime caused by force majeure, third-party service failures, or circumstances beyond its control.

10. Limitation of Liability

To the maximum extent permitted by law, Nextmotion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Nextmotion's total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.

11. Termination

Either party may terminate the Subscription with 30 days' written notice. Nextmotion may suspend or terminate access immediately if you breach these Terms.

Upon termination, you may request export of your data within 30 days. After this period, Nextmotion may delete your data in accordance with its data retention policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
